Terms of Use

    These Terms of Use ("Terms") are an agreement between you and Crest88 LLC ("Crest88," "we," "us"). They govern your use of crest88.com — our public website — and the Crest88 platform: our AI agent platform, available to clients at brain.crest88.com and related subdomains (the "Platform").

    By using the website or the Platform, you agree to these Terms. If you do not agree, do not use them.

    If your organization has a signed engagement letter or services agreement with Crest88, that agreement controls wherever it conflicts with these Terms — including on data ownership, fees, liability, and termination. These Terms fill the gaps; they do not override what we have signed.

    1. Who may use the Platform

    The Platform is a business product. Access is provided to companies we work with ("Clients") and to individuals invited into a Client's workspace ("Users"). By using the Platform you confirm that:

    • You are at least 18 years old
    • You are using it on behalf of a Client, under an invitation authorized by that Client
    • You will use it only for that Client's legitimate business purposes

    We may suspend or remove access for accounts that violate these Terms or threaten the security of the service.

    2. Accounts and sign-in

    Sign-in is provided through our identity service (including "Sign in with Microsoft" where enabled). You are responsible for keeping your sign-in credentials secure and for activity that happens under your account. Tell us promptly at hello@crest88.com if you believe your account has been compromised.

    3. What the Platform does

    The Platform provides AI agents that work with your organization's business systems and content — for example: triaging and drafting email, organizing tasks and business records, running and transcribing meetings, answering questions from your organization's knowledge, and voice-driven operation of the product. Features vary by engagement and evolve over time.

    4. Connected accounts — your authorization

    The Platform can connect to outside services your organization uses (currently: Gmail/Google Workspace, Microsoft 365/Outlook, Slack, Asana, and QuickBooks/Xero). By connecting a service, you represent that:

    • You have the authority to grant that access on behalf of your organization and the account in question
    • The access complies with your organization's own policies and any obligations it owes to others

    Connections can be revoked by an authorized user at any time. Connected services are governed by their own terms and privacy policies in addition to these Terms.

    5. AI features, drafts, and actions taken on your behalf

    You understand and agree that:

    • AI output can be wrong. The Platform generates content — email drafts, summaries, extracted records, answers, transcripts — using artificial intelligence. It may be inaccurate, incomplete, or outdated. It is assistance, not professional advice (legal, financial, tax, or otherwise).
    • You are the reviewer. Where the Platform proposes an action with outside effect — most importantly sending an email from your connected account — it is designed to require human approval. When you approve an action, you are responsible for it, exactly as if you had done it by hand.
    • Where you (or your organization) configure automation to act without per-item review, your organization accepts responsibility for those actions and should confine automation to appropriate, low-risk work.
    • Voice and transcription are imperfect. Transcripts are machine-generated and may contain errors; verify anything important against the source.

    6. Your data, our engine

    • Your organization's data stays your organization's. The business content you bring to the Platform, and the configured knowledge built from it (records, facts, transcripts, indexes, and workflows configured for your business), belong to your organization and can be exported. You grant Crest88 the license needed to host, process, and operate on that data to provide the service — nothing more.
    • The engine stays ours. The Platform's software, models of operation, prompts, agent architectures, evaluation systems, telemetry, and everything else that makes it work are Crest88's intellectual property (or that of our licensors). No rights in the engine are transferred by these Terms, and engine internals are not included in data exports.
    • Feedback you give us about the product may be used to improve it, without obligation to you.

    7. Acceptable use

    You agree not to:

    • Access another organization's workspace or data, or probe, scan, or test the vulnerability of the service without written permission
    • Use the Platform to send spam or unlawful communications, or to infringe anyone's rights
    • Upload malicious code, or use the service to build a competing product
    • Misuse AI features to generate unlawful, deceptive, or harmful content
    • Resell or provide access to the Platform to anyone outside your Client workspace
    • Interfere with the operation of the service or circumvent its security or approval controls

    8. Third-party services

    The Platform depends on third-party providers (including AI providers and cloud infrastructure — see our Privacy Policy for the current list). We choose them carefully, but we are not responsible for their independent acts, outages, or terms. Your use of a connected service remains subject to that service's own agreement with you.

    9. Availability and support

    We work to keep the Platform reliable, but it is provided without a guaranteed service level unless your engagement letter says otherwise. We may modify, add, or retire features. If we retire something material to your engagement, we will tell you and work through it with you.

    10. Ending an engagement — export and offboarding

    When a Client engagement ends, or on request by an authorized owner:

    1. Your organization may export its data from within the Platform
    2. We run a formal offboarding: connected-account access is revoked, your content and indexes are deleted, workspace encryption keys are destroyed, and a deletion receipt is produced
    3. We retain only limited records after offboarding (audit logs on their normal schedule, billing/tax records, and the deletion receipt), as described in our Privacy Policy

    Export links are time-limited for security. We recommend exporting before confirming offboarding — deletion is permanent.

    11. Fees

    Fees for the Platform and related services are set in your organization's engagement letter or services agreement, not in these Terms. The public website is free to use.

    12. Disclaimers

    THE WEBSITE AND PLATFORM ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, CREST88 DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED — INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT — AND DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI-GENERATED OUTPUT WILL BE ACCURATE OR RELIABLE.

    13. Limitation of liability

    TO THE FULLEST EXTENT PERMITTED BY LAW: (a) CREST88 WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, OR DATA; AND (b) CREST88'S TOTAL LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS WILL NOT EXCEED THE AMOUNTS YOUR ORGANIZATION PAID CREST88 FOR THE PLATFORM IN THE TWELVE (12) MONTHS BEFORE THE CLAIM — OR ONE HUNDRED DOLLARS ($100) FOR WEBSITE-ONLY USERS. IF YOUR ORGANIZATION'S SIGNED AGREEMENT SETS DIFFERENT LIABILITY TERMS, THAT AGREEMENT CONTROLS.

    Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

    14. Indemnification

    If you use the Platform on behalf of a Client, that Client agrees to defend and indemnify Crest88 against third-party claims arising from (a) content or data the Client brings to the Platform, (b) connections the Client authorizes without proper authority, or (c) actions the Client approves or automates through the Platform — except to the extent caused by Crest88's own breach of these Terms.

    15. Changes to these Terms

    We may update these Terms. For material changes affecting Platform users, we will give notice through the product or by email before they take effect. Continued use after the effective date means the updated Terms apply.

    16. General

    • Governing law: these Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law rules. Any dispute will be resolved in the courts of that state.
    • Entire agreement: these Terms, the Privacy Policy, and (for Clients) the signed engagement documents are the full agreement; the signed documents win any conflict
    • Assignment: you may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets
    • Severability & waiver: if a provision is unenforceable, the rest stands; not enforcing a provision is not a waiver
